1. Status of Terms

1.1 These terms constitute a legal document ("the Agreement"), which sets out the rights and obligations of you as a purchaser ("you"), and those of AJ's Studio & Camera Supplies ("AJ's Photo Video Limited", "we" or "us"), in relation to the services and products offered by us through this site or any of the other sites owned by us. By registering for AJ's Studio & Camera Supplies services, you agree to the terms of this Agreement, and you re-affirm that agreement every time you use any of our services. Failure to read our Terms and Conditions (Terms of Service) provides no excuse after purchases, or obligations have been made.

1.2 You agree to:

1.2.1 Provide true, accurate, current and complete information about you (also read shipping details) as prompted by our registration form (such information being the "Registration Data"); and

1.2.2 Maintain and promptly update the Registration Data to keep it true, accurate, current and complete. If you provide any information that is untrue, inaccurate, not current or incomplete, or AJ's Studio & Camera Supplies has reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, AJ's Studio & Camera Supplies has the right to suspend or terminate your account, or business, cease supply and refuse you any and all current or future use of the AJ's Studio & Camera Supplies site (or any portion of it).

2. Place of performance and applicable law.

AJ's Photo Video Limited is a Limited company. Unless otherwise specified, the materials on this site are directed solely at those who access this site from the United Kingdom mainland. AJ's Photo Video Limited makes no representation that any product referred to in the materials on this site is appropriate for use, or available, in other locations. Those who choose to access this site from other locations are responsible for compliance with local laws if and to the extent local laws are applicable. English law shall govern this Agreement. You and we each submit to the exclusive jurisdiction of the English courts in relation to disputes arising out of this Agreement.

3. Placing an order

3.1 All prices and charges on this site are in UK pounds. They include VAT payable at 20%, and also exclude delivery charges.

3.2 The total cost of your order will be the price of the products you order and the applicable delivery charge.

3.3 Prices, offers and products are subject to availability and may change before, but not after, we accept your order. If something becomes unavailable we may offer you an alternative or suggest that you visit one of our stores.

IMPORTANT: we try very hard to ensure that all information on this site is accurate. However,  errors can occur. If we discover an error in the price or description of a product you have ordered, we may cancel your order at any time up to the point we send you the product(s) (even if you have received your order confirmation email). We will contact you where we become aware of an error and ask whether you wish to continue with your order at the correct price or cancel it. If we do cancel your order, you will receive a full refund of any charges paid in advance. But not any fees incurred like interest or currency fluctuations if buying from outside the UK

4. Cancellation/Returns Policy

4.1 Subject to the right of consumers to return goods for refund under the Consumer Contracts Regulations 2013 and the Consumer Rights Act 2015, AJ’s does not sell products on a trial basis. Customers are strongly advised to check suitability and specifications of products before ordering. Consumables such as background paper, tapes, flash tubes, modelling lamps, bulbs, or other incandescent lamps will only be accepted as a return if they have not had tags, other seals broken, tampered with, or destroyed.

4.2 You have the right to cancel a purchase up to 14 days after receipt of the last possession (“the Returns Period”), subject to the terms and conditions in this returns policy.

4.3 You have the right to cancel this contract within 14 days without giving any reason. The cancellation period will expire after 14 days from the day on which you acquire, or a third party other than the carrier and indicated by you acquires, physical possession of the last good. To exercise the right to cancel, you must inform us [AJ's Studio & Camera Supplies, Unit 6A, Old Mill, Business Park, Station Road, Bruton, Somerset, BA10 0EH, United Kingdom, info@aj-s.co.uk, 01749813044] of your decision to cancel this contract by a clear statement (e.g. a letter sent by post, or email). You may use the attached cancellation form HERE, but it is not obligatory. To meet the cancellation deadline, it is sufficient for you to send your communication concerning your exercise of the right to cancel before the cancellation period has expired.

4.4 If you cancel this contract, we will reimburse to you all payments received from you, excluding the costs of delivery (except for the supplementary costs arising if you chose a type of delivery other than the least ex-pensive type of standard delivery offered by us). We may make a deduction from the reimbursement for loss in value of any goods supplied, if the loss is the result of unnecessary handling by you. We will make the reimbursement without undue delay, and not later than – (a) 14 days after the day we receive back from you any goods supplied, or (b) (if earlier) 14 days after the day you provide evidence that you have returned the goods, or (c) if there were no goods supplied, 14 days after the day on which we are informed about your decision to cancel this contract. We will make the reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of the reimbursement. We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest. You shall send back the goods or hand them over to us without undue delay and in any event not later than 14 days from the day on which you communicate your cancellation from this contract to us. The deadline is met if you send back the goods before the period of 14 days has expired. You will have to bear the direct cost of returning the goods. You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the goods.

4.5 All returns are subject to the following conditions, except where the goods are faulty or incorrectly described on the Web Site.

Any use of the product is relative to examining it, and ensuring it suits your needs. We can’t accept items that have obvious evidence of heavy use, such as scuffs, marks, scratches or a high flash/shutter count. AJ’s does not sell products on a trial basis.

  • Where the item has been used within the 14-day returns period, we may make a further deduction from any refund if the value of the goods has been reduced.
  • Software, memory cards and DVDs can only be accepted if still sealed. This policy is to avoid any potential breach of the Copyright, Designs and Patents Act (CDPA) 1988. All opened software is exempt from return under the terms of the Consumer Contracts Regulations 2013. Software that arrives damaged or is physically faulty may be returned under our normal returns policy.
  • It is returned with the original box, packing and any accessories you received with it.
  • A proof of purchase must be supplied.
  • You also return any free gifts which came with the product, which also must be in their original packaging and in a saleable condition

4.6 The right to cancel does not apply to the following kind of contracts:

  • Contracts or purchases of consumables that have been opened, damaged,  had tags or other seals broken, tampered with, or destroyed.
  • Contracts for the supply of goods that are made to the consumer’s specifications or are clearly personalised.
  • Contracts for the supply of goods which are liable to deteriorate or expire rapidly.
  • Contracts for the supply of sealed goods which are not suitable for return due to health protection or hygiene reasons and were unsealed after delivery
  • Contracts for the supply of sealed audio or sealed video recordings or sealed computer software which were unsealed after delivery.
  • Contracts for bespoke and custom made components.
  • Contracts for all Infinity Cove components and HiGlide installations, see section 4.13 in our terms below.

4.7 If you exercise your right to cancel your order within 14 days (where the goods are not found to be faulty), you will be refunded within 14 days, including the costs of delivery.

We will make the reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise. We will withhold reimbursement until we have received and inspected the goods.

4.8 All special order items are non-refundable. Special order items are deemed as items not listed on our website, or showing as currently out of stock, or especial ordered for you, the client.

4.9 Faulty goods For faulty goods we offer the following terms:

  • You will always have the option of an exchange or refund if the fault occurs within 14 days of delivery.
  • If the fault has occurred within the first six months after delivery but after the first14 days, you can ask us to repair or replace faulty goods. However, we can choose the solution that is more proportionate or practical for us. In the majority of cases, we will send an item for repair in the first instance. If the repair is unsuccessful, you can then claim a replacement or a full refund. Alternatively we will seek to agree a price reduction with you if you wish to keep the product.
  • After six months, unless you can demonstrate that the fault was present at the time of original delivery or we have previously arranged a repair and this has failed to resolve the fault, our liability will be limited to providing you with reasonable support to make a claim under the manufacturer’s warranty, where applicable.

In all cases we reserve the right to inspect the product and verify the fault and, if no fault is found, return the product to you. In these circumstances, no refund will be processed until the returned goods have been received by us and an appraisal made as to any fault. This promise does not cover faults caused by accident, neglect, misuse or normal wear and tear.

4.9 Any refund due to a fault or other defect will include a refund of the delivery charge. In such circumstances we will also arrange collection of the faulty item (excluding small items that can be sent via Royal Mail). Beyond six months you will be responsible for covering the costs of returning the goods (unless you have been able to establish that the goods were defective at the time of original delivery, in which case we will reimburse your costs as set out above). We strongly recommend you use an insured method such as Royal Mail Special Delivery. Replacement goods are sent by standard delivery only (i.e. premium services are not available).

4.9.1 Shipping refund. Where items have been despatched and recived by the you the client or your represenative we reserve the right to not rerfund our original shipping costs on items returned that were purchased in error or as unwanted gifts, and we rereserve the right to charge the forementioned re-stocking fee seen in 4.7 of our returns policy. This excludes faulty goods or items that have arrived damaged where a full shipping refund will be given.

4.10 Refunds will be processed within 30 days of receipt of the returned products.

We will make the reimbursement without undue delay, and not later than –

  1. 30 days after the day we receive back from you any goods supplied, or
  2. (if earlier) 30 days after the day you provide evidence that you have returned the goods, or
  3. if there were no goods supplied, 30 days after the day on which we are informed about your decision to cancel this contract.

4.11 Deposits

All deposits are non-refundable. When you the client, or the clients representative pays a deposit you the client, or the clients representative are paying in part for a product or service. Paying a deposit means that you the client, or your representatives intend to buy the item/items and or services and means you are entering into a contract with AJ’s Studio & Camera Supplies. There may or may not be a contract in writing, but conducting the order verbally, in writing, email, social media, or any other form of digital correspondence with a deposit payment means a contract is in place.

4.11.1 We will however refund a credit if we can’t supply you the client, or the clients representative with the items/items and or service, or we cannot supply by the agreed delivery date.

4.12 This returns policy does not affect your statutory rights. Details of your statutory rights are available from the citizens advice bureau or consumer direct.

4.13 Cancelled and/or deferred projects and other on-site jobs.

Any job cancelled within 21 days of the agreed start date will, where work has been commissioned in the way of a contract or Purchase Order Number, will incur all labour and material charges, accommodation charges, non-cancellable vehicle charges and other non-avoidable cost, to also include outsourced labour and tool hire. AJ’s Studio & Camera Supplies  reserve the right to charge 25% ‘re-stocking fee’ to cover labour and handling expenses for all products not purchased within the quotation for any cancelled project or jobs where a contract or Purchase Order Number has been provided by the client or client’s approved contractor considered a commission, or agreement to provides goods, labour, or other services requested by means of an email, and any other document, be it paper, or in any other digital form of contract and purchase order number.

4.13.1 Deferred projects, not previously agreed.

Non-agreed deferred projects or jobs within 7 working days of the agreed start date will incur charges in the way of - labour, perishable and non-perishable material charges, all extra accommodation charges due to change of date, non-cancellable vehicle charges and other non-avoidable cost, including external and outsourced labour and tool hire.

4.13.2 AJ's Studio & Camera Supplies define 'agreed' as - a contract or Purchase Order Number that has been provided by the client or client’s approved contractor, or agent considered a commission, or agreement to provide goods, labour, or other services requested by means of an email, and any other document, be it paper, or in any other digital form of contract, purchase order number and or deposit.

4.14 Deferral periods longer 30 days 

Deferral periods longer 30 days will incur a rolling 0.5% fee of the total invoice value unless agreed otherwise before the 7 days mentioned above.

4.15 All special order items

Special order items are strictly non-cancellable and non-refundable. This includes all Cove-Lock components, custom fabrication of Infinity Cove components, and bespoke HiGlide components, to also include items showing as out of stock, on ‘backorder’ or not shown on our main www.aj-s.co.uk website as these are deemed as non-stock items.

4.16 Project or on-site work Deposits
All projects requiring bespoke work such as Cove-Lock, or HiGlide builds and installation will require a minimum of a 30% deposit unless agreed in writing by both parties

5. Content

5.1 AJ's Studio & Camera Supplies shall not be liable to any person for any loss or damage, which may arise from the use of any of the information contained in any of the materials on this site. AJ's Studio & Camera Supplies will only be liable for consequential losses within the contemplation of the parties.

5.2 Certain links in this site (typically a banner advert or icon) will lead to sites, which are not under the control of AJ's Studio & Camera Supplies. When you activate any of these you will leave the AJ's Studio & Camera Supplies site and AJ's Studio & Camera Supplies has no control over and will accept no responsibility or liability for the material on any site, which is not under the control of AJ's Studio & Camera Supplies.

6. Limitation of Liability

6.1 Nothing in this Agreement shall affect the statutory rights of any consumer or exclude or restrict any liability for death or personal injury arising from the negligence or fraud of AJ's Studio & Camera Supplies.

6.2 Subject to clause 6.1, you agree that AJ's Studio & Camera Supplies shall not be liable either in contract, tort, negligence, statutory duty or otherwise, for any direct loss or damage (including loss or damage which is reasonably foreseeable or occurs naturally in the course of things) resulting from any acts, omissions, failures or delays occurring on or in relation to those parts of the Internet not under AJ's Studio & Camera Supplies direct control including, without limitation, damage for loss of business, loss of sales, non payment of sums due, loss of profits, business interruption, loss of reputation, loss of business information, or any other pecuniary loss (even where AJ's Studio & Camera Supplies has been advised of the possibility of such loss or damage).

6.3 The only liabilities that AJ's Studio & Camera Supplies can exclude are those arising from the following.

6.3.1 In cases where losses were not foreseeable to both parties when the contract was formed.

6.3.2 Where losses were not caused by any breach on the part of AJ's Studio & Camera Supplies.

6.3.3 For any business losses, and/or losses to non-consumers.

7. Delivery

7.1 Orders received by 1.00pm are normally dispatched the same day for next day delivery (excluding weekends and public holidays).

7.2 Risk in the goods shall pass to the customer immediately on delivery. Notwithstanding delivery and the passing of risk, all goods supplied shall remain the property of AJ's Studio & Camera Supplies until the customer has paid off all outstanding sums due to AJ's Studio & Camera Supplies, and not only the sums due under this invoice. AJ's Studio & Camera Supplies reserves the right to enter the customer's premises to retrieve the goods in the event of any default in payment.

7.3 Delivery times quoted by AJ's Studio & Camera Supplies are estimates only and AJ's Studio & Camera Supplies shall not be held liable for any consequential loss or damage resulting from any failure to meet estimated times.

7.4 Consideration for damage to, or shortage of, goods in transit will only be given if written notification is received within 2 days of receipt by the customer of such goods. Packing materials in which goods were received should be kept for inspection. Where there is apparent damage to boxes or packaging, the consignment should be opened and examined in the presence of the carrier or, where this is not possible, the carrier's delivery documentation should be amended to read "box damaged - goods unchecked" before the goods are signed for.

7.5 Claims for non-delivery of goods will only be considered if notification is received in writing within 7 days of the invoice date.

9. Copyrights

All designs, text, graphics and their selection and arrangement on this site are the copyright of AJ's Studio & Camera Supplies or its content providers. As a visitor to the AJ's Studio & Camera Supplies site you are licensed to copy electronically or to print portions of this site for your own personal, non-commercial use. Any other use of materials on this site without AJ's Studio & Camera Supplies prior written consent is strictly prohibited.

10. Matters Beyond our Reasonable Control

AJ's Studio & Camera Supplies shall not be held liable for any breach of this Agreement caused by circumstances out of its control including, but not limited to, Acts of God, fire, lightening, flood, or extremely severe weather, explosion, war, disorder, flood, industrial disputes (whether or not involving our employees), acts or omissions of Internet services providers or acts of local or central Government or other competent authorities.

11. Language

In the event of conflict or inconsistency between the terms of the English language version of this Agreement and any translation provided by us, the English language version shall prevail.

12. Export

Where goods are supplied for export from the UK, any term or expression which is defined in the provisions of Incoterms shall import the respective obligations of buyer and seller into these General Terms and Conditions. The provisions of this clause shall (subject to any special terms agreed in writing between AJ's Studio & Camera Supplies and the customer) apply notwithstanding any other provision of these General Terms and Conditions.

12.1. International shipping rates may vary depending on the country that we are shipping to. Typical transit time is between 5-10 business days, but very occasionally items can experience customs delay of several weeks.

12.2. Risk of loss and title for merchandise shipped internationally will pass to you upon our delivery to the carrier. Your order may be subject to import duties and taxes, which are levied once a shipment reaches your country. You may be responsible for paying additional charges for customs clearance; we have no control over these charges and cannot predict what they may be. Customs policies vary widely from country to country; please contact your local customs office for further information before purchase.

12.3. Additionally, when ordering from AJ's Studio & Camera Supplies, you are the importer and must comply with all laws and regulations of the destination country. Placing your export order with us means that you authorise us to designate a carrier to act as your agent with the relevant customs and tax authorities in the destination country, to clear your merchandise and advance (on your behalf) any duties and taxes owed by you. All prices are final.

12.4. Customers wishing to pay VAT in their own countries can, but on telephoned orders and orders requested by email only. We only ship to theses customers once we have fully checked you VAT number and will only ship to the address relating to your VAT number. We reserve the right to cancel your order at anytime if you have provided us with incorrect or false information or VAT numbers. We also reserve the right to charge you 20% of the original total if we incur any costs with and or relating to cancelled orders resulting from the above aforementioned fraud, false information or fraudulent VAT numbers.

13. Accounts

Accounts: AJ's Studio & Camera Supplies will give written confirmation of credit terms when a customer opens an account, and we reserve the right to vary these terms from time to time. Failure to comply with our credit terms will result in suspension or withdrawal of credit facilities. As per www.gov.uk/ we reserve the right to charge interest at 8% plus the Bank of England base rate for business to business transactions on overdue accounts and to recharge any collection costs incurred. All goods supplied shall remain the property of AJ's Studio & Camera Supplies until the customer has paid off all outstanding sums due to AJ's Studio & Camera Supplies, and not only the sums due under this invoice. AJ's Studio & Camera Supplies reserves the right to enter the customer's premises to retrieve the goods in the event of any default in payment.

14. Pricing

We reserve the right to amend our prices at any time and without prior notice - orders are fulfilled on the understanding that prices charged are those current at the date of despatch. All prices are exclusive of applicable VAT, which the customer shall be liable to pay to AJ's Studio & Camera Supplies.

15. Hire

The Owner hereby hires to the Hirer the Equipment for the Hire Period and at the Rentals in each case as stated in the Schedule hereto upon the terms and subject to the conditions hereinafter appearing.

15.1. The Hire Period will be calculated as follows:

(a) 1 day: Any 24 hour period commencing from the time the Equipment arrives at the hirer's premises until it is sent from the hirer's premises;

15.2. A deposit of a minimum of 20% will be held/taken from the hirer's account to cover loss/damage of equipment.

15.3. Payment for hire must be made in advance of the hire excluding customers with accounts.

15.4. Whilst the goods are in the possession of the hirer, the hirer is entirely responsible for any loss, damage, theft or act of God, and will be liable to pay for repair or replacement at the full value + VAT of item should any incident occur. Insurance should be taken out to cover the cost of the kit.

16. GDPR

General Data Protection Regulation (GDPR)

What is GDPR?

The new General Data Protection Regulations come into force across the EU on the 25th May 2018. The regulation is an EU law on data protection and privacy for all individuals within the European Union. It also addresses the export of data outside the EU. The GDPR aims primarily to give control back to citizens and residents over their personal data, minimise and restrict access to personal information.

How do we use your information?

The personal information we hold on your behalf was supplied to us by way of online order, telephone call, email, trade shows, social media, live chat, account application form, or letter is subject to any subsequent amendments made at your request. These details are held electronically on our secure CRM and accounting systems.

The personal information we hold about you is as follows:

  • Name(s) including titles and or position
  • Business name
  • Contact information – address or addresses, emails, telephone numbers, website home page address and social media contact information.
  • Payment information and transactions (only dates paid, payment type)
  • Other information relevant to customer surveys and/or offers and sales history

AJ's will only use the above information for the following purposes:

  • Internal record keeping
  • Sending customer invoices, statements, quotations, delivery information and general order processing.
  • Payments and credit verification.
  • Promotional emails about new products, special offers or other information which we think will be of interest.
  • If at any time you wish to withdraw your consent to receive sales and advertising information, please contact us and appropriate action will be taken.
  • We do not keep any credit card or store card details what so ever. All possible payment slips are cross shredded once payment has been confirmed and accounted for.
  • Your details will not be passed to third parties for any other reason other than for order processing.

AJ's Studio & Camera Supplies Privacy Policy

Due to the ordering process certain information given by you at the time of ordering is collected lawfully and in accordance with the General Data Protection Regulation, and used solely by AJ's Studio & Camera Supplies. AJ's Studio & Camera Supplies does not disclose any customer information to any third parties except to facilitate the ordering process. The information is used only for the purpose of processing your request and to communicate with you on any matters relating to the provision of the service in general. Information and statistics may also be used for the purpose of monitoring site usage. These statistics will not include any information that can be used to identify any individual.
